Badgers and their setts are protected under the Protection of Badgers Act (1992), and badgers are of material consideration when planning and designing developments.
A preliminary ecological appraisal (PEA) or extended Phase 1 survey will include surveying for badger setts and other signs or presence. This may be sufficient to inform an impact assessment; alternatively, it will flag up the need for further survey to establish the status of the sett (degree of use and extent of the sett/territory).
